TERMS AND CONDITIONS
Please read these Terms and Conditions carefully before using Artymind or purchasing promotional services.

Terms and Conditions
Version 1.1 — Last updated: October 20, 2026
Welcome to Artymind. These Terms and Conditions govern access to and use of the Artymind website, online platform, marketplace and related services.
Please read them carefully before registering, activating a campaign or purchasing a promotional service.
1. Owner and Contact Information
Artymind is owned and operated by:
Artymind di Lorenzo Felicani
Via Caduti di Via Fani, 4
40019 Sant'Agata Bolognese (BO), Italy
VAT Number: IT04297561203
Email: info@artymind.io
Website: https://www.artymind.io
Throughout these Terms, “Artymind”, “we”, “us” and “our” refer to the business identified above.
2. Acceptance of Terms and Eligibility
By registering for an account, using the Platform or purchasing services, users agree to comply with these Terms and Conditions.
These Terms apply to Artists, Curators and other registered users, except where a provision expressly applies to a specific category.
The Platform is intended for users aged 18 or older who have the legal capacity to enter into binding agreements.
Users acting on behalf of a company, publication, label or other organization confirm that they have the necessary authority to represent that entity.
Acceptance of these Terms does not replace any separate consent, acknowledgement or request expressly required by applicable law.
Nothing in these Terms excludes or restricts mandatory consumer or business-user protections.
3. Description of the Platform
Artymind is an online marketplace connecting independent musicians and artists with music curators, bloggers, radio professionals, playlist curators and other promotional content creators.
The Platform allows Artists to upload music, create promotional campaigns, receive offers, explore the marketplace, communicate with Curators and purchase specific promotional services.
Curators may offer services including music reviews, interviews, articles, radio coverage, social media promotion, editorial consideration and other activities clearly described in their offers.
Artymind provides campaign activation, marketplace infrastructure, communication tools, administrative support and payment coordination.
Artymind does not sell artificial streaming, guaranteed Spotify playlist placement or guaranteed promotional performance.
4. Roles and Contractual Responsibilities
Artymind operates through a marketplace model involving three parties.
Artists submit music and purchase promotional opportunities or services.
Curators independently propose and deliver promotional services.
Artymind operates the Platform and supplies its own campaign activation, visibility and related marketplace services.
Campaign activation and optional Platform features are sold directly by Artymind.
Individual promotional services are offered by Curators. Unless expressly stated otherwise, the Curator is responsible for providing the service described in the accepted offer.
Artymind may review Curators, approve offers, moderate content, administer payments and assist with disputes.
These activities do not automatically make Artymind the contractual supplier of a Curator's independent promotional service.
Artymind remains responsible for its own obligations and for any liability that cannot lawfully be excluded.
5. User Registration and Accounts
Registration is required to access the main features of the Platform.
Users must provide accurate, truthful and up-to-date information.
Each user is responsible for maintaining the confidentiality of their account credentials and promptly reporting suspected unauthorized access.
Users must not impersonate other persons, create fraudulent accounts or provide misleading information about their identity or professional activities.
Artymind may request additional information where reasonably necessary for account verification, fraud prevention or compliance with applicable law.
Users may request account closure by contacting info@artymind.io.
Account closure does not automatically cancel existing payment obligations, ongoing collaborations, lawful record-retention requirements or unresolved disputes.
6. Artist Accounts and Uploaded Materials
Artists may submit music and supporting promotional materials, including audio recordings, artwork, biographies, press kits, photographs, music links and other information relevant to their releases.
Artists confirm that they own or have obtained the necessary rights and permissions to upload, share and authorize promotional use of these materials.
Artists retain ownership of their original content and intellectual property.
By uploading materials, Artists grant Artymind a non-exclusive, royalty-free license to store, process, display and communicate the materials to participating Curators as reasonably necessary to operate the Platform and facilitate requested services.
Where necessary for an authorized collaboration, Curators may use the Artist's name, artist name, likeness, artwork, audio excerpts and supplied promotional materials within the scope of the agreed service.
Such permission does not authorize unrelated commercial exploitation, resale or unauthorized redistribution.
Artists remain responsible for ensuring that the materials they submit do not infringe third-party rights.
7. Free Campaign Trial
Eligible Artists may access an initial 3-day free campaign trial.
During the trial, Artists may submit a release, receive Curator offers and preview available promotional opportunities.
Certain features, including full Curator details and the ability to accept paid collaborations, may remain restricted until campaign activation.
The free trial does not constitute a recurring subscription.
No payment is collected automatically at the end of the trial.
Artists may decide whether to activate their campaign.
Trial eligibility and any applicable limitations are communicated through the Platform.
8. Paid Campaign Activation
Artists may activate a campaign by paying the applicable one-time activation fee.
The standard activation price is €30, unless a valid discount or promotional credit applies.
A paid campaign runs for 30 days from activation, with the precise expiration date shown through the Platform where available.
Once payment is successfully completed, the campaign becomes active and is made available to eligible Curators.
Campaign activation provides access to Artymind's promotional marketplace and collaboration-management functionality.
The activation fee does not include the price of individual Curator services.
A campaign may receive different numbers and types of offers depending on the release and participating Curators.
No minimum number of offers is guaranteed.
Campaign activation is not an automatically renewing subscription.
9. Optional Campaign Boost
Artymind may offer an optional Campaign Boost for an additional one-time payment, currently €5.
A Boost provides increased campaign visibility in the Curator feed by prioritizing the boosted campaign over non-boosted campaigns.
The Boost period is normally up to 7 days from activation.
Boost visibility is available only while the underlying campaign remains eligible and active. If the campaign expires earlier, the period of effective visibility may be shorter.
A Boost does not extend the original campaign duration.
Purchasing a Boost does not guarantee any minimum number of offers, collaborations, streams or other promotional results.
The price, applicable duration and relevant conditions must be displayed before purchase.
Mandatory consumer rights remain unaffected.
10. Curator Registration, Verification and Authorization
Curators may register to offer promotional services through Artymind.
Curators must provide accurate information about their identity, publication accounts, promotional channels and services.
Artymind may review and approve Curator accounts, publication profiles and offer templates before allowing them to be used.
When submitting an offer template, Curators must confirm that they have permission to publish offers and promotions on behalf of the selected publication or promotional channel.
This confirmation applies to blogs, playlists, radio stations, social media accounts and other supported publication types.
Curators confirm that they own or are authorized to operate the relevant promotional channel and to offer the services described.
Curators must not misrepresent their relationship with a publication, exaggerate audience statistics or claim access to channels they do not control or represent.
Artymind may request reasonable evidence of authorization or ownership.
An offer or publication may be rejected, removed or suspended if the information is inaccurate or cannot be adequately verified.
The publication authorization declaration is separate from the acceptance of these Terms and Conditions.
11. Curator Offers and Collaborations
Curators may create promotional offer templates, including Basic and Standard offers.
Each offer must accurately describe the service, deliverables, applicable publication channel, price and relevant conditions.
Artists may receive direct Curator offers or purchase eligible services through the marketplace.
Artists are free to review the available opportunities and decide which services to purchase.
A binding paid collaboration is formed when the applicable offer is accepted and the required payment process is completed.
Curators must provide the agreed service in accordance with its description and any agreed conditions.
Material changes to an accepted offer require the agreement of the parties involved.
Artists must provide the information and promotional materials reasonably necessary for the agreed work.
Curators must not advertise services that they are unable or unauthorized to perform.
12. Prices, Checkout and Payment Processing
Artymind processes online purchases through supported third-party payment providers, including Stripe.
Campaign activation, Campaign Boosts and Curator collaborations are separate purchases.
The standard campaign activation fee is €30.
The standard optional Campaign Boost fee is €5.
Curator services are priced individually according to their published offers.
A separate Platform service fee may apply to Curator transactions.
Under the current standard calculation, this fee is 1.5% of the Curator service price plus €0.25 per transaction, subject to applicable discounts or changes disclosed before purchase.
For example, a Curator service priced at €10 has a standard checkout total of €10.40 before any applicable discount.
Any mandatory taxes, Platform fees and additional costs must be communicated before the Artist confirms payment.
Fees charged specifically for the use of a payment instrument are subject to applicable legal restrictions.
Payment confirmation and related contractual information will be provided as required by law.
No recurring payment is authorized merely by purchasing a campaign or collaboration.
13. Artymind Marketplace Commission
Artymind currently retains a 10% marketplace commission from the agreed Curator service price.
Under the standard model, the Curator is allocated 90% and Artymind retains 10%.
For a service priced at €10, this ordinarily corresponds to €9 for the Curator and €1 for Artymind.
Separately disclosed Artist-facing service fees are distinct from this marketplace commission.
Specific promotional credits, refunds, discounts or commercial agreements may affect the final transaction accounting.
Artymind will communicate changes to commission conditions in accordance with applicable contractual and legal requirements.
14. Curator Earnings and Withdrawals
Curator earnings are recorded through the Platform.
Amounts become eligible for withdrawal following the applicable service-completion and verification procedures.
The current minimum withdrawal amount is €50.
Supported withdrawal methods currently include PayPal and Wise, subject to availability and payment-provider requirements.
Curators must provide accurate payment information.
They are responsible for their own applicable tax and reporting obligations.
Artymind may temporarily delay the release of disputed amounts while reviewing the relevant transaction, subject to applicable law.
Where relevant, users will be informed of payment-provider charges and currency-conversion costs.
Amounts recorded in a Curator's account represent contractual earnings and do not constitute a bank deposit or interest-bearing account.
15. Completion and Verification of Promotional Services
Curators must carry out the activities expressly described in the purchased offer.
Where required, Curators must provide reasonable evidence of completion, such as a published article, social media link, screenshot, radio reference or promotional report.
Artymind may review the submitted information and request further evidence.
Artists may report services that have not been delivered or that materially differ from the agreed description.
Where justified, Artymind may facilitate correction, completion, cancellation or an appropriate refund.
A Curator's right to receive payment is subject to the applicable contractual performance requirements and any mandatory legal protections.
16. Music Promotion and Editorial Integrity
Artymind supports authentic and transparent music promotion.
Users must comply with applicable law and the policies of third-party streaming and social media platforms.
The following practices are prohibited:
Artificial streams, bots or fraudulent engagement.
Guaranteed paid placement on Spotify playlists.
Manipulation of streaming statistics, rankings or engagement metrics.
False promises of guaranteed audience growth.
Fabricated promotional reports or publications.
Misleading audience or channel statistics.
Unauthorized use of copyrighted materials.
Other fraudulent or unlawful promotional practices.
Payments must relate to legitimate, clearly described promotional services.
Curators offering editorial activities must preserve the editorial independence required by the relevant service and platform policies.
Payment does not entitle an Artist to a favorable editorial opinion or guaranteed coverage where editorial selection is part of the service.
Artymind may reject or remove offers that violate these standards.
17. No Guaranteed Promotional Results
Artymind provides opportunities for music promotion but does not guarantee particular promotional or commercial outcomes.
The number, relevance and quality of offers may vary according to the submitted music, genre, campaign timing, participating Curators and other circumstances.
A campaign purchase does not guarantee a specific number of offers or completed collaborations.
A Curator collaboration provides the contractual deliverables described in the accepted offer, not a guaranteed increase in streams, followers, revenue or popularity.
These provisions do not limit any obligation to provide purchased services correctly or any mandatory remedy for non-performance.
18. Refunds and Cancellations
Refund requests are evaluated according to the type of service, the stage of performance, the agreed contractual deliverables and applicable law.
Campaign activation
Campaign activation begins immediately following successful payment.
If a paid campaign receives no Curator offers during its 30-day period, the Artist may contact Artymind for a review.
Artymind may offer a discretionary refund or another appropriate commercial resolution.
This discretionary policy does not affect any statutory right of withdrawal or other mandatory consumer remedy.
Curator collaborations
If a Curator fails to deliver the agreed service, the Artist may report the problem to Artymind.
Depending on the circumstances, the matter may be resolved through correction, completion, cancellation, a partial refund or a full refund.
Disagreement with an honest editorial opinion does not, by itself, establish a failure to perform a properly described editorial service.
Services that are not delivered or are materially non-conforming remain subject to the applicable contractual and statutory remedies.
Campaign Boosts
Refund and cancellation requests relating to Boost purchases are evaluated in accordance with the service supplied and any applicable consumer rights.
Approved refunds are ordinarily processed through the original payment method where technically available.
19. EU Consumer Right of Withdrawal
Consumers who conclude eligible distance service contracts with Artymind generally have the right to withdraw within 14 days of conclusion of the contract, without providing a reason, subject to applicable legal conditions and exceptions.
Where a consumer expressly requests the immediate commencement of a paid service during the withdrawal period, Artymind may begin providing that service before the period expires.
If the consumer subsequently exercises a valid right of withdrawal, a proportionate amount may be payable for the service already supplied, provided the conditions laid down by applicable law have been satisfied.
The immediate activation of a 30-day campaign does not, by itself, automatically eliminate the right of withdrawal.
For paid service contracts, the right of withdrawal may be lost following full performance only where all applicable statutory conditions have been fulfilled, including the required express consent and acknowledgement.
Consumers may exercise their withdrawal rights through an unequivocal declaration sent to:
For eligible online contracts, Artymind must also provide the online withdrawal function required by applicable law.
Online withdrawal function: [LINK TO BE ADDED BEFORE PUBLICATION]
The online function must allow eligible consumers to identify the relevant contract, confirm the withdrawal request and receive an acknowledgement on a durable medium.
Valid withdrawal requests and any related refunds will be handled in accordance with applicable statutory requirements.
The model withdrawal form in Annex A may be used but is not mandatory.
20. International Consumer Rights
Artymind is operated from Italy and may be accessed by users in different countries.
Mandatory consumer protections applicable in the consumer's country of residence or under other relevant laws remain unaffected.
For consumers in the United Kingdom, Brazil and other jurisdictions, applicable statutory cancellation, withdrawal, conformity and refund rights will be respected where the relevant laws apply.
Nothing in these Terms creates a blanket exclusion of such rights.
21. Professional and Non-Professional Curators
Curators may participate as professional traders or, where legally permitted, as individuals acting in a genuinely non-professional capacity.
Having no VAT number does not automatically mean that a Curator is a non-professional seller.
Curators must accurately represent their legal and professional status.
Where required, Artymind will disclose the Curator's declared trader or non-trader status before an Artist purchases that Curator's services.
Where a Curator is not acting as a professional trader, the Artist will be informed, when required, that certain consumer rights arising from contracts with professional traders may not apply to the direct agreement with that Curator.
The contractual responsibility of each party and Artymind's separate obligations remain subject to applicable law.
22. Marketplace Ranking and Visibility
Artymind uses different presentation and ordering mechanisms for campaigns and Curator offers.
Campaign visibility
In the Curator feed, campaigns with an active Boost receive priority over non-boosted campaigns.
Within the relevant groups, release-date information is generally used to determine the display order, with more recent dates appearing first.
Campaign eligibility, moderation, expiration and other Platform restrictions may affect whether a campaign is displayed.
Curator marketplace
Eligible Curator offer templates are normally displayed according to their listing order, with more recently added templates generally appearing first.
Artists may use available filters and sorting functions, including promotional category, country, price and Curator feedback.
The relative importance of ranking criteria depends on whether the user is viewing the default marketplace or has selected a particular sorting option.
Paid visibility
A paid Campaign Boost affects visibility in the Curator feed.
It does not guarantee that a Curator will view the campaign, submit an offer or provide a promotional service.
Artymind's own campaign activation and Boost services are distinct from the independently offered promotional services of Curators.
Any additional paid visibility mechanisms or material ranking changes will be disclosed as required by law.
23. Business-User Transparency and Access to Data
Where applicable, professional Curators benefit from the protections established by Regulation (EU) 2019/1150 and other relevant laws.
Curators may access information about their own accounts, publication profiles, templates, relevant collaborations, recorded earnings and other data made available through their dashboards.
Artists and Curators may access certain information about one another where necessary to assess or perform a collaboration.
Such access is limited by account permissions, Platform functionality, contractual restrictions and data protection law.
Users must not extract, scrape, sell or disclose other users' personal or confidential information without appropriate authorization.
Artymind may use activity and transaction data for Platform operation, administration, security, dispute resolution and service improvement, subject to its Privacy Policy and applicable law.
Users may request access to their relevant personal data or information about available data-export options by contacting support.
Data may be retained after account closure where required or permitted by applicable law.
24. Communications and Off-Platform Transactions
Artymind provides communication tools to facilitate collaborations between Artists and Curators.
Curators must use the Platform's applicable processes to submit, negotiate, accept and administer offers arising from Artymind campaigns.
Users must not intentionally redirect transactions initiated through Artymind to external payment or contracting channels for the purpose of avoiding applicable Platform fees or safeguards.
This restriction does not prevent legitimate external communication necessary to carry out an accepted collaboration, where consistent with the applicable terms.
Artists are encouraged to report attempts to solicit unauthorized off-platform payments.
Artymind may investigate conduct intended to circumvent its payment procedures and take proportionate action in accordance with applicable law.
25. Intellectual Property
The Artymind name, branding, software, design and original Platform materials are protected by applicable intellectual property laws.
Users receive only the limited rights necessary to access and use the Platform in accordance with these Terms.
Artists and Curators retain ownership of content they lawfully create or provide.
No transfer of copyright occurs solely through registration or the submission of materials.
Users must respect third-party intellectual property rights.
Artymind may remove content where reasonably necessary to address infringement or legal obligations.
Removal of material from Artymind does not necessarily result in the removal of content already lawfully published on independent third-party websites, blogs or social platforms.
Requests concerning personal data remain subject to applicable data protection law.
26. Content Moderation and Illegal Content Reports
Artymind may review accounts, campaigns, publication profiles, offer templates and other Platform content.
The purpose of moderation is to protect users, enforce these Terms, prevent fraud and comply with applicable law.
Prohibited conduct includes impersonation, harassment, spam, copyright infringement, fraudulent offers, unlawful content and deceptive promotional practices.
Users may report suspected illegal content or Terms violations by contacting:
Reports should identify the relevant content, explain the concern and provide supporting information where reasonably available.
Artymind will review reports and take appropriate action according to the circumstances and applicable legal obligations.
Where required, affected users will receive information about moderation decisions, the reasons for restrictions and available review mechanisms.
Artymind may use manual and technical moderation methods.
27. Suspension, Restrictions and Account Termination
Artymind may restrict, suspend or terminate an account for justified reasons, including:
Fraud or intentional deception.
Repeated failure to perform paid services.
Serious or repeated violations of these Terms.
Misrepresentation of publication ownership or authorization.
Unlawful or misleading promotional activity.
Security threats or unauthorized access.
Material violations of applicable third-party platform policies.
Other conduct that creates serious legal or operational risks.
Restrictions will be applied proportionately where required by law.
Artymind will provide the reasons, advance notice and available opportunities for review where legally required.
For professional Curators, applicable Platform-to-Business procedural and notice protections will be respected.
Account termination does not automatically cancel legitimate pending payment obligations or mandatory legal rights.
28. Privacy and Personal Data
Artymind processes personal data in accordance with its Privacy Policy and applicable data protection law.
Cookie and tracking technologies are governed by the applicable Cookie Policy and consent-management settings.
Users can consult these policies separately through the Platform.

The processing of personal data for marketing purposes is subject to the separate legal requirements applicable to those activities.
29. Third-Party Services and Platform Availability
Artymind integrates with third-party services, including Stripe, Spotify, payment providers, social media networks and external websites.
These third parties may operate under their own terms and policies.
Artymind is not affiliated with or endorsed by those providers merely because its users interact with them.
The Platform may occasionally experience interruptions due to maintenance, infrastructure problems, security incidents or third-party service disruptions.
Artymind will take reasonable steps to maintain and restore the services it provides.
Nothing in this section excludes mandatory rights or remedies available to users.
30. Discounts, Credits and Referral Programs
Artymind may provide promotional codes, referral benefits, partnership discounts and promotional credits.
Each promotion is subject to its communicated eligibility rules, validity period, value and usage restrictions.
Referral benefits may be available to Artists, Curators or approved external partners, depending on the applicable program.
Promotional credits are not bank balances and are not redeemable for cash unless expressly indicated.
Fraudulent referrals, unauthorized self-referrals and deliberate misuse of promotions are prohibited.
Artymind may modify future promotional programs, subject to existing contractual rights and applicable legal requirements.
31. Complaints and Dispute Resolution
Artists and Curators may submit complaints to:
Complaints should include sufficient information to identify the relevant account, campaign, offer or transaction.
Artymind aims to provide an initial response within two business days where reasonably possible, although complex disputes may require additional investigation.
For disputes between Artists and Curators, Artymind may review evidence, facilitate communication and administer payment adjustments consistent with the contract and applicable law.
Artymind does not act as a court and does not guarantee a particular outcome.
Professional business users and consumers retain any legally available complaint, mediation, alternative dispute resolution and judicial remedies.
32. Limitation of Liability
To the extent permitted by applicable law, Artymind is not responsible for promotional results outside its reasonable control or for independent editorial decisions made by Curators.
Artymind remains responsible for its own contractual obligations and for matters for which liability cannot lawfully be excluded.
Nothing in these Terms excludes or limits liability for fraud, intentional misconduct or other liability that cannot legally be excluded.
Mandatory consumer and business-user rights remain unaffected.
33. Changes to These Terms
Artymind may update these Terms to reflect changes to its services, functionality, commercial practices or applicable law.
Material changes will be communicated in accordance with applicable legal requirements.
Where Regulation (EU) 2019/1150 applies to a professional Curator's relationship with Artymind, the applicable advance-notice requirements will be respected, including the minimum 15-day period where required and any longer period legally necessary.
Lawful exceptions to the applicable notice requirements remain unaffected.
Changes will not be applied retroactively where prohibited by law.
The current version will be made available through the Platform.
34. Governing Law and Jurisdiction
These Terms are governed by Italian law.
This choice does not deprive consumers of mandatory protections applicable in their country of habitual residence.
Disputes are subject to the jurisdiction of the competent courts determined in accordance with applicable law.
Nothing in these Terms requires consumers to waive mandatory jurisdictional or other legal protections.
35. Contact
